  1. Scope of application

The following General Terms and Conditions shall apply to all business relations between the customer (purchaser) and the vendor, the MdMS, initiated through the online shop at https://shop.museumdermoderne.at/.

 

  1. Prices

All articles ordered from the MdMS online shop shall be sold at the prices displayed in the shopping cart immediately before the order is placed. Prices include Austrian VAT.

 

  1. Shipping charges

Any shipping charges are shown on the order.

 

  1. Purchase agreement

By clicking the “Weiter” button to complete your order after accepting the Terms and Conditions, you place an offer for the conclusion of a purchase agreement between the MdMS and you. The MdMS confirms the receipt of your order both on the following web page and by email. Both forms of confirmation do not constitute acceptance of your offer but serve to notify you that your order has been correctly received.

Your order data is stored by the MdMS. If you would like to store this data on your end, please print the confirmation page or save it (e.g., as a PDF).

The MdMS reserves the right to reject your order in whole or in part due to unexpected difficulties in delivery or a negative credit check. The MdMS will notify you within a reasonable time of the emergence of such circumstances. Any advance payment you have already made for the products that will not be delivered will be returned to you.

The purchase agreement between the MdMS and you is concluded when the MdMS ships the articles you have ordered to you and notifies you that it has done so. Products included in the same order that are not listed in the shipping confirmation message are not covered by this purchase agreement.

 

  1. Delivery

The MdMS ships all articles currently in stock immediately upon receipt of your order. You will receive the products within a reasonable time based on the shipping method. In the event that specific articles are not immediately available due to high demand and cannot be delivered within the specified timeframe, the MdMS will contact you before the end of that timeframe to discuss whether you want to keep your order open.

 

  1. Payment

The MdMS online shop offers you the following methods of payment:

Credit card
If you choose to pay by credit card, the MdMS will charge the payable total to your card. Like all other personal data, your credit card information is transmitted securely (via SSL).

Collect on delivery
If you choose to pay by collect on delivery, you will pay any applicable fees assessed by the delivery agent upon delivery.

 

  1. Warranty and damages

The MdMS vouches that the articles delivered to you are free from defects. The statutory warranty provisions apply. Minor deviations from product specifications do not constitute a defect that results in a warranty claim. The MdMS cannot offer any warranty unless such warranty is expressly stated by the MdMS. The MdMS shall not be liable for slightly negligent breaches of duty, provided that such breaches of duty are not connected to damages from injury to life, body, or health or any warranties offered, or affect claims under the Product Liability Act. The same applies to breaches of duty on the part of any vicarious agents.

 

  1. Data privacy and security

Your personal data and all other information related to your order is transmitted in encrypted form and via a secure SSL connection. The MdMS shall store your name and address and the information related to your order. The MdMS pledges to safeguard your personal data in accordance with the provisions of the Data Privacy Act; see also the MdMS’s Privacy Policy Statement. Your data will be shared with third parties solely for the purpose of fulfilling your order, including, but not limited to, credit card verification, credit check, and address verification.

The MdMS strives to continually improve its online shop’s range of products and services for you. As part of these efforts, we analyze customer and order data on a regular basis and provide you with up-to-date information through our e-mail newsletter. If you object to the use of your data for these purposes, you may let us know at any time; just send us an email to the contact address provided above.

 

  1. Final provisions

All business relations shall be governed solely by Austrian law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the competent court in Salzburg.
