General Terms and Conditions of Business
1 Scope of application
These General Terms and Conditions of Business apply to all business relations between the Customer or Ordering Party and the Contractor, the Museum der Moderne - Rupertinum Betriebsgesellschaft mbH with registered office in 5020 Salzburg, Mönchsberg 32, Austria, which are initiated via the Museum der Moderne Salzburg Museum Shop (www.mdmsalzburg.at).
2 Prizes
For items ordered from the Museum der Moderne Salzburg Museumsshop, only the prices displayed in the shopping basket immediately before the order is submitted apply. The prices include the statutory value-added tax for Austria.

The shipping costs shown in the order apply.
4 Contract
By clicking on the "Continue" button to complete the order process after accepting the terms and conditions, you are submitting an offer to conclude a purchase contract with the Museum der Moderne - Rupertinum Betriebsgesellschaft mbH.
We will confirm receipt of your order both on the subsequent website and by e-mail. Neither constitutes acceptance of your offer, but is intended to inform you that we have received the correct order information.
Your order details will be stored by us. If you wish to retain them, please print out the confirmation page.
The Museum der Moderne - Rupertinum Betriebsgesellschaft mbH is entitled to refuse your order in whole or in part due to unexpected delivery difficulties or a negative credit check. Once we become aware of such circumstances, we will inform you by e-mail within a reasonable period of time. If you have already made advance payments for the undelivered goods, we will of course refund them to you.
The contract between the Museum der Moderne - Rupertinum Betriebsgesellschaft mbH and you is concluded when we send the ordered items to you and inform you of this by e-mail. No purchase contract is concluded for products from one and the same order that are not listed in the shipping confirmation.
5 Delivery
The Museum der Moderne - Rupertinum Betriebsgesellschaft mbH ships all items in stock immediately after receipt of your order. You will receive the goods, including the shipping method, within a reasonable period of time.
If certain items are not immediately available due to high demand and if, in this case, the stated delivery period cannot be met, we will contact you no later than the expiry of this period to agree with you whether the order should be maintained.
6 Payment
You can pay in the Museum der Moderne Salzburg Museum Shop in the following ways:
Credit card
If you choose to pay by credit card, the Museum der Moderne - Rupertinum Betriebsgesellschaft mbH will debit the amount due from your credit card account. Like all other personal data, your credit card information is transmitted securely (via SSL).
Cash on delivery
If you choose cash on delivery, you will be charged the applicable fees of the delivery company upon delivery.
7 Warranty and compensation
Museum der Moderne - Rupertinum Betriebsgesellschaft mbH guarantees that the items delivered to you are free of defects. The statutory warranty provisions apply. Minor deviations in the goods do not constitute a defect giving rise to a warranty claim. However, as a matter of principle, we cannot grant a guarantee unless we expressly declare it. The Museum der Moderne - Rupertinum Betriebsgesellschaft mbH is not liable for slightly negligent breaches of duty, insofar as these do not concern damage resulting from injury to life, limb or health or any guarantees granted or claims under the Product Liability Act are affected. This also applies to breaches of duty by any vicarious agents.

Your personal data as well as all other information regarding your order will be encrypted and transmitted via a secure SSL connection.
We store your name and address as well as order-related data. Of course, we assure you of the comprehensive protection of your personal data in accordance with the provisions of the Data Protection Act.
Your data will only be passed on to third parties in the context of fulfilling your order, e.g. for any necessary credit card, creditworthiness or address checks.
Of course, we are constantly striving to improve the range and service of the MdM Museum Shop for you. Regular evaluations of customer and order data as well as up-to-date information in our e-mail newsletter contribute to this. 9 Final provisions
Austrian law shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the competent court in Salzburg.
